TERMS AND CONDITIONS

 

1 – SUBJECT: THIS AGREEMENT IS MADE AND ENTERED INTO BY AND BETWEEN FUGAZORIGEM – UNIPESSOAL, LDA. (HEREINAFTER REFERRED TO AS “TEIXCAR”), THE CUSTOMER (HEREINAFTER REFERRED TO AS THE LESSEE) AND THE ADDITIONAL DRIVERS NAMED THEREIN. THIS DOCUMENT OUTLINES THE TERMS OF THE RENTAL AGREEMENT BETWEEN TEIXCAR (THE LESSOR) AND THE LESSEE, WHO ACKNOWLEDGES FULL UNDERSTANDING AND AGREES TO ABIDE BY THE TERMS AND CONDITIONS SPECIFIED HEREIN.

 

2 – CONDITION OF THE VEHICLE: THE CUSTOMER ACKNOWLEDGES RECEIVING THE VEHICLE IN OPTIMAL MECHANICAL CONDITION, COMPLIANT WITH ALL LEGAL REQUIREMENTS IN THE PORTUGUESE REPUBLIC FOR ITS DESIGNATED PURPOSE, INCLUDING ALL FIVE TIRES IN GOOD CONDITION.

 

3 – MINIMUM RENTAL PERIOD: THE MINIMUM RENTAL PERIOD IS 1 DAY (24 HOURS). FOR DELAYS EXCEEDING 1 HOUR, AN ADDITIONAL DAY OF RENTAL WILL BE CHARGED.

 

4 – DRIVER: TO DRIVE OUR VEHICLES, THE CUSTOMER AND ALL ADDITIONAL DRIVERS NEED TO BE AT LEAST 26 YEARS OLD AND HAVE HELD A FULL DRIVING LICENCE, VALID IN PORTUGAL, FOR AT LEAST 3 YEARS.

 

5 – FUEL: VEHICLES MUST BE RETURNED WITH THE SAME FUEL LEVEL AS AT THE TIME OF PICK-UP. FAILURE TO DO SO WILL RESULT IN THE CUSTOMER BEING CHARGED FOR THE MISSING FUEL, CALCULATED AT PREVAILING MARKET RATES ON THE SPECIFIED DATE, PLUS A €25 ADMINISTRATION FEE.

 

6 – VEHICLE RENTAL PRICES: PRICES CAN VARY DEPENDING ON TIME OF YEAR.

6.1 – GROUP A – FROM €35/DAY; GROUP B – FROM €40/DAY.

 

6.2 – DEPOSITS: PRICES VARY: GROUP A STARTING FROM €600.00; GROUP B STARTING FROM €750.00.

 

7 – INSURANCE AND EXTRAS

 

7.1 – COLLISION DAMAGE WAIVER (CDW) COVERAGE: INCLUDED. IN THE EVENT OF AN ACCIDENT, THE CUSTOMER IS ONLY RESPONSIBLE FOR PAYING UP TO THE MINIMUM DEDUCTIBLE LIMIT.

 

7.2 – DEDUCTIBLE: PRICES VARY: GROUP A STARTING FROM €600.00; GROUP B STARTING FROM €750.00.

 

7.3 – AIRPORT SERVICE FEE: AIRPORT PICK-UP AND RETURN OF VEHICLES INCUR AN ADDITIONAL FEE OF €25.00 PER TRANSFER BETWEEN 08:30 AM AND 07:30 PM (OUR COUNTER OPERATING HOURS).

 

7.4 – HOTEL SERVICE FEE: HOTEL PICK-UP AND RETURN OF VEHICLES INCUR AN ADDITIONAL FEE OF €25.00 PER TRANSFER BETWEEN 08:30 AM AND 07:30 PM (OUR COUNTER OPERATING HOURS).

 

7.5 – PICK-UP AND RETURNS OUTSIDE OF THE STATED OPENING TIMES INCUR AN ADDITIONAL FEE OF €40.00 PER TRANSFER.

 

7.6 – CHARGED EXTRAS: BABY SEAT €3.00; CHILD SEAT €2.00 (DAILY RATES. SERVICES AVAILABLE UPON RESERVATION).

 

7.7 – ADDITIONAL DRIVER – €10.00 FEE.

 

8 – PRICES INCLUDE: VAT, LIMITED LIABILITY INSURANCE, MAINTENANCE, AND 24/7 ROADSIDE ASSISTANCE. IN THE EVENT OF CUSTOMER RESPONSIBILITY, AN ADDITIONAL €65 FEE WILL BE APPLIED.

 

9 – PRICES DO NOT INCLUDE: COLLISION DAMAGE WAIVER (CDW), LOSS DAMAGE WAIVER (LDW), Super Collision Damage Waiver (SCDW), IN COMPLIANCE WITH TRAFFIC REGULATIONS, PERSONAL ACCIDENT INSURANCE (PAI), AIRPORT TRANSFERS, PARKING FEES, FINES, FUEL, LOSS OF DOCUMENTS (A CHARGE OF €150.00 WILL APPLY TO THE CUSTOMER FOR REISSUANCE), LOSS OF KEYS (A CHARGE OF €190.00 WILL APPLY TO THE CUSTOMER FOR REPLACEMENT), AND INADEQUATE REFUELLING (A CHARGE OF €250.00 WILL APPLY TO THE CUSTOMER). THE CUSTOMER IS LIABLE FOR ALL DAMAGES CAUSED BOTH TO THE RENTED VEHICLE AND THIRD PARTIES WHENEVER THE VEHICLE:

 

9.1 – IS DRIVEN BY ANY PERSON WITHOUT A VALID DRIVER’S LICENCE OR AUTHORIZATION FROM TEIXCAR;

 

9.2 – INCURS ANY DAMAGE INTENTIONALLY CAUSED BY THE CUSTOMER OR ANY INDIVIDUAL UNDER THEIR RESPONSIBILITY;

 

9.3 – IS OPERATED BY ANYONE UNDER THE INFLUENCE OF ALCOHOL, NARCOTICS, OR EXPERIENCING MENTAL INCAPACITY;

 

9.4 – IS USED IN SPORTING EVENTS, RALLIES, CHALLENGES, COMPETITIONS, ETC.;

 

9.5 – IS INVOLVED IN ANY INCIDENT, NOT REPORTED TO TEIXCAR AS SOON AS REASONABLY POSSIBLE UNDER THE CIRCUMSTANCES;

 

9.6 – IS SUBJECT TO VANDALISM RESULTING IN DAMAGE SUCH AS BROKEN GLASS, BURST TIRES OR DAMAGED RIMS;

 

9.7 – TIRE BURST AND DAMAGE TO THE LOWER PART OF THE VEHICLE (E.G. UNDER THE ENGINE);

 

9.8 – NEGLIGENT DRIVING AND RELATED DAMAGE;

 

9.9 – THE CUSTOMER IS RESPONSIBLE FOR ANY TRAFFIC VIOLATIONS COMMITTED DURING THE RENTAL PERIOD.

 

10 – IN THE EVENT OF AN ACCIDENT, THE LESSEE MUST PROMPTLY CONTACT THE LOCAL POLICE AUTHORITIES (112) AND INFORM TEIXCAR THROUGH OUR ASSISTANCE SERVICE AS SOON AS REASONABLY POSSIBLE UNDER THE CIRCUMSTANCES.

 

11 – IN THE EVENT OF A DISPUTE, THE CUSTOMER CAN SEEK THE ASSISTANCE OF AN ALTERNATIVE DISPUTE SETTLEMENT BODY: CENTRO DE ARBITRAGEM DE CONFLITOS DE CONSUMO DA REGIÃO AUTÓNOMA DA MADEIRA (CACCRAM). 12 – DATA PROTECTION – THE LESSEE CONSENTS FOR THEIR PERSONAL INFORMATION TO BE ENTERED INTO THE LESSOR’S DATABASE, ALLOWING IT TO BE PROCESSED FOR THE PURPOSES OUTLINED HEREIN, INCLUDING MARKETING ACTIVITIES, CUSTOMER SATISFACTION SURVEYS, AND UPDATES ABOUT OUR PRODUCTS AND SERVICES, PURSUANT TO THE GENERAL DATA PROTECTION REGULATION (LAW NO. 58/2019, OF AUGUST 8). THE LESSEE CAN EXERCISE THEIR RIGHTS UNDER THE GDPR BY SENDING US A REGISTERED LETTER TO: TEIXCAR, ESTRADA REGIONAL 222, 87B, PICO BANDA ALÉM, 9350-137 RIBEIRA BRAVA OR NA EMAIL TO TEIXCAR.MADEIRA@GMAIL.COM.

 

13 – CONSUMER RIGHTS – WE PROVIDE BOTH PHYSICAL AND ELECTRONIC COMPLAINTS BOOKS (WWW.LIVRODERECLAMACOES.PT) AS MANDATED BY DECREE-LAW NO. 156/2005, OF 15 SEPTEMBER, AMENDED BY DECREE-LAW NO. 74/2017, OF JUNE 21. ADDITIONALLY, THE LESSEE HAS THE OPTION TO FILE A COMPLAINT WITH THE PORTUGUESE TRANSPORT MOBILITY AUTHORITY VIA EMAIL AT RECLAMACOES@AMT-AUTORIDADE.PT.
